‘Dead Wrong’: Mark Cuban Gets Corrected By Biden Official While Defending Race-Based Hiring
Andrea Lucas, commissioner of the EEOC, responded that any employment decisions based on race or sex would violate the Civil Rights Act of 1964.
“Unfortunately you’re dead wrong on black-letter Title VII law. As a general rule, race/sex can’t even be a ‘motivating factor’—nor a plus factor, tie-breaker, or tipping point. It’s important employers understand the ground rules here,” Lucas tweeted.
To be clear, diversity of opinions, thoughts, and perspectives is a likely contributor to organizational success. But it can never replace merit, competence, and dedication to organizational goals as a means of making decisions on hiring and advancement.
We salute Commissioner Lucas for standing firm on established legal principles.
